Nº 1Agreement to Terms

By accessing or using Cheeppy ("Service"), operated by Théo Diamant, Entrepreneur Individuel (EI), trading as Cheeppy ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

Nº 2Description of Service

Cheeppy is an AI-powered platform that enables users to generate professional product images using artificial intelligence. Our Service includes:

• AI image generation using various styles and recipes created by our community
• Image upload and processing capabilities
• Integration with e-commerce platforms (Shopify, WooCommerce, etc.)
• Credit-based usage system for generations
• Creator tools for publishing AI recipes

Nº 3User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Nº 4Payments, Subscriptions and Credits

Cheeppy operates on a credit-based system. Credits are required to generate images and are consumed based on the resolution and complexity of each generation.

4.1 Subscriptions and Automatic Renewal

By subscribing to a paid plan, you authorize Cheeppy to charge you the subscription fee at the frequency (monthly or yearly) and amount displayed at the time of purchase. Your subscription will automatically renew at the end of each billing period until you cancel. You may cancel your subscription at any time through your account settings or the Stripe billing portal.

• Subscription plans renew automatically at the then-current price unless cancelled before the renewal date
• If you cancel, your subscription remains active until the end of the current billing period — you will not be charged again after that
• Monthly credits included in your subscription do not roll over to the next billing period
• Downgrading or cancelling your plan does not entitle you to a refund for the current period

4.2 Credits

Cheeppy uses a two-pool credit system:

• Subscription credits — included with each paid plan and refreshed to the tier's monthly allocation at every billing cycle (any unused balance is forfeited and replaced, not rolled over). If you cancel or your subscription ends, your subscription credit balance is reset to zero.
• Purchased credit packs — one-time top-ups bought separately from a subscription. They remain valid for 90 days from the date of purchase and are not affected by subscription cancellation; you keep them until they are used or expire.
• All credits are non-refundable, non-transferable, and cannot be exchanged for cash or moved between accounts.

4.3 No Refunds

All fees paid for the Service are non-refundable. If you cancel your subscription, you are not entitled to any refund or credit for the remaining time in your current billing period. Cheeppy may, at its sole discretion, issue refunds or credits on a case-by-case basis, but is under no obligation to do so.

Image credit refunds. As a courtesy, Cheeppy may credit back the credits used for a generation that is genuinely defective or unusable (for example a broken, corrupted, or failed image) when you report it through the in-app request flow and our team approves it after review. This credit-back is reviewed on a case-by-case basis at our sole discretion, is not a guarantee, and does not apply to images that are functional but simply not to your subjective taste, nor to changes of mind. We may decline any request, and we may limit, suspend, or terminate accounts that abuse this process — including repeated or bad-faith requests, or requests to refund usable images.

4.4 Price Changes

We reserve the right to change our prices at any time. If we change the pricing for your subscription, we will notify you at least 30 days before the change takes effect. Continued use of the Service after the price change constitutes your agreement to pay the updated amount.

4.5 Right of Withdrawal

If you are a consumer resident in the European Union or the European Economic Area, you normally have fourteen (14) days from the conclusion of the contract to withdraw from it without giving any reason.

The Service consists of digital content supplied immediately. At checkout, you expressly request that we begin performance right away, and you acknowledge that you thereby lose your right of withdrawal once your credits are made available to you — in accordance with Article 16(m) of Directive 2011/83/EU and Article L221-28 13° of the French Consumer Code. Credits are made available as soon as your payment is confirmed.

Nº 5Creator Program and Payouts

5.1 Creator Eligibility

The Creator Program is available to approved users who publish AI recipes on Cheeppy. By participating in the Creator Program, you agree to the terms in this section in addition to all other Terms of Service. Cheeppy reserves the right to approve, reject, or revoke creator status at its sole discretion, without notice or obligation to provide a reason.

5.2 Commission and Earnings

Creators may set a commission (0 to 100 credits) on each recipe they publish. When another user generates an image using a creator's recipe, the creator earns the commission amount converted to USD at a rate of $0.01 per credit.

• Cheeppy retains a 20% platform fee on all creator earnings. For example, a 5-credit commission yields $0.05 gross, of which $0.01 is the platform fee and $0.04 is the creator's net earning.
• Creators do not earn commissions on generations made with their own recipes (self-generation).
• Earnings are tracked in US dollars (cents) and are separate from the credit system.
• Cheeppy reserves the right to modify commission limits and the platform fee percentage at any time, with 30 days' notice.

5.3 Payouts via Stripe Connect

To receive payouts, creators must complete onboarding with Stripe Connect Express, our third-party payment processor. By onboarding, you also agree to Stripe's Connected Account Agreement.

• The minimum payout threshold is $10.00 USD. You may request a payout once your available balance reaches this amount.
• Payouts are processed via Stripe Transfer to your connected bank account. Processing times depend on Stripe and your bank (typically 2-7 business days).
• Only one payout request may be active at a time.
• Cheeppy is not responsible for delays, failures, or fees imposed by Stripe or your financial institution.
• If a payout transfer fails, the amount will be restored to your earnings balance automatically.

5.4 Earnings Reversal

If a generation fails after a creator earning has been recorded, the earning will be automatically reversed and deducted from the creator's balance. Cheeppy reserves the right to reverse earnings in cases of suspected fraud, abuse, or Terms violations.

5.5 Tax Obligations

Creators are solely responsible for reporting and paying any taxes owed on their earnings, including income tax, VAT, or any other applicable taxes in their jurisdiction. Cheeppy does not withhold taxes on creator payouts. Depending on your location and total earnings, Stripe or Cheeppy may be required to report your earnings to tax authorities (e.g., IRS Form 1099 for US-based creators). You agree to provide accurate tax information when requested.

5.6 Creator Content and Conduct

• Recipes must produce results consistent with their title, description, and preview images.
• Creators must not publish recipes that infringe on third-party intellectual property.
• Cheeppy may remove, suspend, or modify any recipe at any time without notice.
• Repeated violations may result in removal from the Creator Program and forfeiture of unpaid earnings.

5.7 Termination of Creator Status

If your creator status is revoked or your account is terminated, any pending earnings below the minimum payout threshold will be forfeited. Earnings above the minimum threshold that have not yet been paid out will be processed within 30 days of termination, provided no fraud or Terms violation is suspected. Cheeppy reserves the right to withhold payouts pending investigation of suspected abuse.

Nº 6Intellectual Property

6.1 Your Content

You retain ownership of any images you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the Service to you.

6.2 Generated Images

Images generated through our Service are owned by you, subject to the following conditions:

• You may use generated images for personal and commercial purposes
• You may not claim that AI-generated images are photographs or human-created works when this would be misleading
• You are responsible for ensuring your use complies with applicable laws

6.3 Recipes and Styles

AI recipes and styles created by our community creators remain the intellectual property of their respective creators. Using a recipe to generate images grants you rights to the output, not to the recipe itself.

Nº 7Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, threatening, abusive, defamatory, or obscene content
• Create deepfakes or misleading content featuring real individuals without their consent
• Infringe upon the intellectual property rights of others
• Generate content that promotes violence, discrimination, or illegal activities
• Attempt to reverse-engineer, decompile, or extract our AI models or systems
• Use automated systems (bots, scrapers) to access the Service without authorization
• Circumvent any usage limits, security measures, or access controls
• Resell, redistribute, or sublicense access to the Service

Zero tolerance for objectionable content. Cheeppy operates a zero-tolerance policy toward objectionable content and toward abusive behaviour directed at other users or creators. We may remove any such content and suspend or permanently terminate the accounts of users who violate this policy, at our sole discretion and without notice. You can report content you believe violates these Terms using the in-app report tools or by emailing [email protected].

Nº 8Service Availability

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Emergency maintenance or security updates
• Technical failures or issues with third-party services
• Force majeure events

Nº 9Limitation of Liability

To the maximum extent permitted by law, Cheeppy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Service interruptions or failures
• Any damages arising from your use of generated content

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Nº 10Indemnification

You agree to defend, indemnify, and hold harmless Cheeppy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Nº 11Cancellation and Termination

11.1 Cancellation by You

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. You will not be charged after the current period ends. No partial refunds are provided for the remaining time in a billing period.

When the current billing period ends and the subscription is fully cancelled, your subscription credit balance is reset to zero. Purchased credit packs are not affected by cancellation— they remain valid until they are used or until their 90-day expiry, whichever comes first (see §4.2).

11.2 Termination by Cheeppy

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms, suspected fraud, or abusive behavior.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. All unused credits are forfeited and will not be refunded. Your generated images may be deleted after a reasonable period following termination. Sections of these Terms that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Nº 12Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.
